Dr Bateman worked on a range of clinical research projects. The assessor recommended that Miss Kelly should be held against her will. Miss Kelly did not want to be in a facility, so she called Dr Ramanathan Elayaperumal, her psychiatrist. He was a Consultant Psychiatrist with the Home Treatment Team at Essex Partnership NHS Foundation Trust.

In response to the recommendation that was made, the Home Treatment Team performed a comprehensive evaluation on Miss Kelly's current health and mental state. The evaluation included an in-depth medical history and physical exam. It also included a thorough psychological and family therapy assessment as well as a psychiatric diagnostic interview.

According to the report, Miss Kelly was afflicted by multiple mental health issues, including borderline personality disorder, bulimia-nervosa, and anorexia nervosa. She was also assaulted by her husband and was an addict to drugs. Her symptoms were exacerbated by anxiety, stress and depression. She was also diagnosed with bipolar affective disorder and schizoaffective disorders.

Elayaperumal claims Medtronic has discriminated against him due to his race or national origin. He claims that his poor performance review in June 2000 and the inability to give him certain assignments for projects were motivated by racism or national animus. However there is no evidence to suggest Medtronic's decision-making was based on those factors. Elayaperumal’s lower performance rating did not cause any reduction in his salary or benefits.
