Veterans Disability Lawsuit - How to File a Veterans Disability Lawsuit

A lawsuit for disability claims by veterans could be the solution for a large number of veterans suffering from disabilities due to their military service. The Department of Veterans Affairs provides benefits to those who have been in the military, such as medical care and specialty programs.

However, obtaining those benefits is particularly difficult for Black veterans, as per a new lawsuit filed Monday. The Yale Law School Veterans Legal Services Clinic filed the suit on behalf of Conley M. Monk Jr.

The condition can cause people to avoid certain places or situations that bring back memories of the traumatic event. This can lead individuals to feel isolated and depressed. Counseling, medication, and support from family members can help to treat PTSD.

A lawsuit that was filed jointly by Black veterans and Yale law clinics has revealed that the Department of Veterans Affairs denied disability compensation claims of Black veterans repeatedly over a long period of time. Quil Lawrence of NPR reports that a VA whistleblower told the vets that VA documents showed that Black veterans were denied benefits at a higher percentage than their white counterparts.

The lawsuit was filed by Marine Vietnam veteran Conley monk and Yale's oak harbor veterans disability attorney Legal Services Clinic. It cites data showing that from 2001 to 2020 the rejection rate for Black disability claims was 29.5 percent, as compared to 24.2% for white veterans.

The lawsuit seeks to recover compensation for lawyers Monk and Black veterans who were unfairly denied benefits. The lawsuit also seeks to for the VA to reconsider tens of thousands of claims that were wrongly denied. The lawsuit was filed this week in federal court.

Traumatic Brain Injury

TBI can be mild, moderate or even severe and symptoms can be immediately evident or develop hours or even weeks after the injury. Some signs (headache dizziness, fatigue, headache) are physical, while others can include memory, concentration, emotion or behavior problems. TBI patients may also have problems with movement or balance and vision.

The damage to the brain due to a TBI can be caused by a blow, bump or jolt to the head, whether it's from a force that is blunt or a penetrating wound (such as from a bullet). The impact could cause the skull to break, causing bruising and bleeding of the brain within the skull. The brain may swell and push against the skull, cutting off blood circulation. The injury may affect the entire brain or a specific area of the brain.

Certain TBIs are classified as open and some are closed. The classification is determined by whether or not the skull has been broken and whether the skull was opened or shut due to the impact. TBIs can range in severity from a concussion to the coma. People who suffer from TBIs are more at risk likelihood of developing depression and PTSD, as well as other mental health issues. Some research suggests that having multiple moderate to severe TBIs could increase the chance of developing dementia and movement issues in later life.

Antidepressants such as selective Serotonin Reuptake Inhibitors (SNRIs) are beneficial for some people with PTSD. Medications can help control the symptoms and make it easier to get through everyday activities.

The lawsuit claims that the VA has discriminated against Black veterans for a long time, through a disproportionate refusal of disability compensation claim in a higher proportion than white veterans. Conley Monk is a Vietnam War veteran, who has been trying to obtain medical benefits in the form of housing, educational and medical benefits for over 50 years. The suit was filed by Yale Law School's Veterans Legal Services Clinic, which represented Monk in his successful effort to reverse his less than honorable military discharge due to PTSD and other injuries.

The lawsuit asserts that racial discrimination within the military justice system impacted the discharge status of Black service members and VA officials should have been aware of this when making decisions about disability compensation. It cites research that found that between 2001 and 2020 the average rate of denial for Black veterans who applied for disability compensation was 29.5 percent, as compared to 24.2% for white veterans.
