Asbestos Legal Matters

After a long battle the asbestos legal framework led to the partial ban on the production, processing, and distribution of the majority of asbestos-containing products. This ban is still in place.

Legislation

In the United States, asbestos laws are enforced both at the state and federal level. The US uses asbestos in a range of products even though the majority of industrialized countries have banned it. The federal government regulates the way it is used in these different products and regulates asbestos litigation and abatement. State asbestos laws may differ from state to state even though federal laws generally apply to all states. These laws restrict the rights of those who have suffered asbestos-related injuries.

Asbestos is a naturally occurring mineral. It is typically mined using open-pit methods. It consists of fibrous fibers. These strands then are processed and mixed with a binding agent, such as cement to produce an asbestos-containing substance, also known as ACM. The Environmental Protection Agency (EPA), however, has strict rules regarding how asbestos can be used in schools and in homes. The EPA requires that all workers who work with asbestos must be certified and accredited.

The EPA's Asbestos Ban Phase-Out Rule of 1989 was designed to ban the manufacture, importation processing, distribution and export of asbestos products within the US.
