They sabotage her health by forcing her to perform for tourists, putting too much stress on her with head-first dives, which expose her to chlorine, making her lose weight and harming her immune system. They also put her in a tank one-and-a half times smaller than her natural habitat.

In 2022, the new owner of Miami Seaquarium, who calls Lolita as a cousin of theirs, vowed to come up with plans with a group of Lolita supporters known as Friends of Toki, and the Lummi Tribe to transport her eventually to open water. The plan included a sanctuary pen on the west coast of Washington where she could spend the rest of her days and receive human care and be monitored by scientists. The sanctuary pen could be hundreds of times larger than her Miami home and be surrounded by the ocean itself not a concrete tank.

If the plan was successful, Lolita (also called Tokitae or Toki) could still be alive. In the wild, killer whales are highly social animals that are bonded with family members until they die. Lolita who has been in a solitary space at Seaquarium in a secluded area for over 40 years, is being released into the wild. Activists from across the country have demanded Lolita's retirement from Seaquarium and then release into the wild.
