After a long battle in the asbestos legal arena, asbestos legal measures led to the partial prohibition on the manufacturing processing, distribution, and distribution of the majority of asbestos-containing products. This ban remains in effect.

The final TSCA risk assessment for chrysotile identified excessive health risks to humans in all current uses of chrysotile. The April 2019 rule bans the return of these asbestos-containing products to the market.

Legislation

In the United States, asbestos laws are enforced at both the state and federal level. The US uses asbestos in a variety of different products even though many industrialized countries have banned it. The federal government regulates the use of asbestos in these products and also regulates asbestos litigation. State asbestos laws vary from one state to the next however federal laws generally are uniform. These laws restrict the claims of those who have suffered asbestos-related injuries.

Asbestos occurs naturally. It is extracted from ground usually using open-pit mining techniques and is composed of fibrous strands. These strands are then processed and mixed with a binding agent such as cement to create an asbestos-containing material, also known as ACM. These ACMs are used in many applications, such as floor tiles, roofing, clutch facings, and shingles. Apart from its use in construction materials, asbestos can be found in a variety of other products, such as batteries gaskets, fireproof clothing, and gaskets.

While there is no asbestos-related ban in the United States, the Environmental Protection Agency (EPA) has strict guidelines for how asbestos can be used in schools and homes. The EPA requires schools to inspect their facilities and come up with plans for the identification, containment and management of asbestos-containing materials.
