Asbestos Legal Matters

After a long and arduous battle and a long period of legal action, asbestos legal measures resulted in the partial ban in 1989 of the manufacture, processing and distribution of many asbestos-containing products. This ban is still in effect.

The December 2020 final TSCA risk evaluation for chrysotile asbestos found unacceptable health risks to humans for all ongoing use of chrysotile asbestos. The rule of April 2019 prohibits these ongoing asbestos products from returning to commercial use.

Legislation

Asbestos laws are controlled at the federal and state levels in the United States. Although most industrialized nations have banned asbestos, the US continues to use it in a number of different products. The EPA's Asbestos Ban Phase-Out Rule of 1989 was formulated to stop the importation, production processing, distribution and export of asbestos-related products in the US. The ban was lifted in 1991. Additionally the EPA has recently started reviewing chemicals that could be harmful and has put asbestos on its list of chemicals to be considered hazardous.
