Asbestos Legal Matters

Legislation

Asbestos law is regulated at the state and federal levels in the United States. Although most industrialized nations have banned asbestos but the US still uses it in many different products. The federal government regulates how it is used in different products and the law also regulates asbestos litigation and abatement. State asbestos laws can differ from one state to another however federal laws are generally uniform. These laws usually restrict claims of those who have suffered from exposure to asbestos.

Asbestos is a natural mineral. It is mined by open-pit methods. It consists of fibrous fibers. The strands are then processed and mixed with a binding agent, such as cement to create an asbestos-containing material, or ACM. These ACMs are used in a variety of applications, such as floor tiles, shingles roofing and clutch facings. Asbestos is not only used in construction materials but also in other products, such as batteries, fireproof clothing, and gaskets.

While there isn't any asbestos-related ban in the United States, the Environmental Protection Agency (EPA) has strict guidelines for the use of asbestos in schools and homes. The EPA demands that schools inspect their facilities and create plans for identifying, containing and managing asbestos-containing materials. The EPA demands that anyone who works with asbestos must be certified and accredited.

The EPA's Asbestos Ban Phase-Out Rule of 1989 was created to prohibit the production, importation, processing, and distribution of asbestos-related materials within the US. This was reverted in 1991. In addition, the EPA has recently begun reviewing chemicals that could be dangerous and has placed asbestos on its list.
