In response to this recommendation In response to this recommendation, the Home Treatment Team conducted a comprehensive evaluation of Miss Kelly's state of mind and functioning. The evaluation included a thorough medical history as well as a physical exam. It also included a thorough assessment of family and psychological therapy and a psychiatric diagnostic assessment.

According to the report the report states that Miss Kelly was suffering from a variety of mental health issues, such as borderline personality disorder, bulimia nervosa and anorexia nervosa. She also had an addiction history to drugs and had experienced domestic violence. Stress, anxiety and depression caused her symptoms to worsen. She was also diagnosed as having bipolar affective and schizoaffective disorders.

Elayaperumal claims that Medtronic deliberately discriminated against him because of his race and national origin. He claims that his poor performance review in June of 2000 as well as the decision not to award him certain assignments were influenced by racism. Medtronic has not provided any evidence to show that its decisions were based on these factors. The lower rating for Elayaperumal's performance did not result in a reduction in his compensation or benefits.
